  • We do not take ownership of, sell, resell, or distribute any products
  • We do not verify, endorse, or guarantee any products sold through our platform
  • We do not participate in any transactions between sellers and buyers

4.2. Our Platform provides:

  • E-commerce store creation and management tools
  • Inventory management system
  • WhatsApp order integration
  • Store listing and product management capabilities

4.3. Service Limitations:

  • We do not process payments directly
  • Orders are redirected to WhatsApp for completion
  • We do not guarantee WhatsApp's availability or functionality
  • We do not guarantee any sales or business outcomes
  • We are not responsible for any disputes between sellers and their customers

4.4. Notice and Takedown:

  • We may, but are not obligated to, remove any content if legally required
  • We reserve the right to suspend access to the platform if required by law
  • We may respond to valid legal notices regarding content on our platform

5. User Obligations

5.1. You agree to:

  • Comply with all applicable laws and regulations
  • Maintain accurate inventory information
  • Respond to customer inquiries and orders in a timely manner
  • Use the Platform in accordance with these Terms

5.2. You are prohibited from:

  • Using the Platform for any illegal purposes
  • Attempting to bypass or manipulate our systems

  • Selling counterfeit, fake, or harassment products

6. Content and Products

6.1. Seller Responsibility and Discretion:

You have full discretion over what products you choose to sell in your store. You retain complete and sole responsibility for:

  • All products listed in your store
  • All content in your store, including:
    • Product descriptions and titles (whether manually created or AI-generated)
    • Product images (whether original or AI-modified)
    • Product pricing
  • Review and verification of all content before publication
  • Product quality and delivery
  • Customer service and dispute resolution
  • Any claims or legal actions arising from your products
  • Compliance with all applicable laws and regulations
  • Any intellectual property matters related to your products

6.2. AI-Enhanced Content and Ownership:

Our Platform provides AI tools to:

  • Generate product descriptions and titles
  • Modify product images (background removal, shadow effects, etc.)

You are responsible for:

  • Reviewing and approving all AI-generated text content
  • Verifying that AI-modified images accurately represent your products
  • Ensuring all images, whether AI-modified or not, truly represent the actual products
  • Ensuring you have proper rights to use and modify all images

Image Usage Restrictions:

  • AI-modified images created through our Platform can only be used within magaz.app
  • You may not use, copy, download, or distribute AI-modified images for use on other platforms or websites
  • AI-modified images remain available only while your store is active on magaz.app
  • Violation of these image usage restrictions may result in immediate account termination

Using our AI tools does not transfer any responsibility from you to the Platform.

You must ensure all content, whether AI-enhanced or not, is accurate and compliant with applicable laws.

6.3. While we manually review stores, we:

  • Do not actively monitor individual products or content
  • Are not responsible for verifying product authenticity or legal compliance
  • May share seller information if legally required to do so

6.4. Indemnification:

You agree to indemnify and hold magaz.app harmless from any claims, damages, losses, liabilities, costs, and expenses (including legal fees) arising from:

  • Any products you sell through our platform
  • Any claims related to your products
  • Any legal issues arising from your store operations

7. Data Collection and Privacy

7.1. Data Protection Compliance

We comply with applicable data protection laws including Turkish data protection regulations and, where applicable, the EU General Data Protection Regulation (GDPR).

7.2. Data We Collect:

  • Your business information
  • WhatsApp contact number
  • Store inventory data

7.3. Data Usage by Region:

  • In Kyrgyzstan: We use Posthog for tracking user interactions and analytics purposes.
  • In the EU (including Germany): We only use technical cookies that are essential for platform functionality. We do not collect or process any personal data beyond what is strictly necessary for providing our service.

7.4. We commit to:

  • Protecting your data with reasonable security measures
  • Using your data only for providing and improving our Service
  • Not sharing your data with third parties except as required for service operation
  • Providing access to your data upon request
  • Retaining data only for as long as necessary for the purposes for which it was collected

12. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of Turkey, without regard to its conflict of law provisions.

12.2. Dispute Resolution

Any dispute arising out of or in connection with these Terms shall be resolved through good faith negotiations between the parties. If the dispute cannot be resolved through negotiation, it shall be submitted to the exclusive jurisdiction of the courts of Ankara, Turkey.

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these Terms will otherwise remain in full force and effect.
